ALL individuals entering or partcipating in a batting cage or a FIELDHOUSE program must have a PARTICIPANT form signed either by them or if you are under the age of 18 years, then signed by a parent/legal guardian or designated representative.

In consideration of being allowed to participate in any way at THE FIELDHOUSE (“Releasees”) and its programs, related events and activities, including but not limited to practices and/or games at fields, and/or batting cages (hereinafter “Activities”), the undersigned acknowledges, appreciates, and agrees that:

Assumption of Risks: I am not aware of any injury, illness, or any other health related issues that would restrict or limit my child’s ability to perform activities at THE FIELDHOUSE. As a participant, my child recognizes and acknowledges that there are certain risks, and my child agrees to assume these risks, including but not limited to injury, death, damages, or loss (collectively the “risks”), which he or she may sustain as a result of participating in any and all practices, games, and other activities associated with the THE FIELDHOUSE. If my child elects to voluntarily participate, he or she does so with knowledge of the danger and the numerous risks involved. My child hereby agrees to accept and assume any and all risks of injury (including death) from any cause whatsoever relating to his/her participation on or involvement at THE FIELDHOUSE, including but not limited to passive or active negligence on the part of others.

Severability: I further expressly agree that the foregoing assumption of risks and waiver/release of liability is intended to be as broad and inclusive as is permitted by applicable law and that if any portion of this Agreement is held invalid or unenforceable, it is agreed that the balance shall continue in full legal force and effect.

Acknowledgment of Understanding: I have read this Liability & Assumption of Risk Agreement in its entirety, fully understand its terms, and understand that I am giving up substantial rights, including my right to sue. I acknowledge that I am signing the agreement voluntarily, with my own free will, and intend by my signature to be a complete and unconditional assumption of risks and waiver and release of all liability to the greatest extent allowed by law. Additionally, I willingly agree to comply with the stated and customary terms and conditions for participation. If, however, I observe any unusual significant hazard during my presence or participation,
including any of the above issues, I will remove my child and/or myself from participation and bring such to the attention of the nearest official and coach immediately; and
 

Parental Acknowledgment: This is to certify that I, as parent/guardian, with legal responsibility for this participant. I, for myself or son / daughter / player and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE AND HOLD HARMLESS THE FIELDHOUSE, their officers, officials, agents and/or employees, other participants, sponsoring agencies, sponsors, advertisers, coaches, managers, volunteers and if applicable, owners and lessors of the premises used to conduct the event ("Releasees"), WITH RESPECT TO ANY AND ALL INJURY, ILLNESS, DISABILITY, DEATH, or loss or damage to person or property, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE.

I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING AND AGREEING TO IT ON MY OWN BEHALF AND ON BEHALF OF THE YOUTH PARTICIPANT. I SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT OR ASSURANCE OF ANY NATURE, AND INTEND IT TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW.
